Historical Background 

Instead of Preface

 

Scientific research and teaching of environmental and law disciplines[1] have rich history and traditions. Suffice it to say that scientific studies in land, mining, and water law were published in Russia as early as 100-200 years ago.   

It is known for certain that in a number of higher education institutions in the Russian Empire some disciplines were taught, which covered certain aspects of environmental management. Thus, for several years running Yu.V. Gautier delivered lecturers on the history of landowning in Russia for the students of Konstantinovsky Mezhevoy (land surveying) Institute[2]. Starting from 1888, at the law faculty of the Imperial Moscow University political economics[3] was taught.  The content of that subject was described as “economics of down-stream industries including forestry, hunting, fishery and mining; upstream industries, trade and transport communications”[4]. In the framework of this a special emphasis was placed on the rational management and care of natural resources.  

However, the formation of a division which, as a training, methodological and scientific center, could support teaching of environmental and law disciplines in the Moscow State University is dated to much later times.   

 

1. History of the Department: facts, personalia, studies

Creation of the Department

In view of the threatened seizure of Moscow by German occupants in October 1941 the USSR Government adopted a Decree on evacuation of Moscow State University named after M.V. Lomonosov to Ashkhabad (Turkmen SSR).The Department was established on March 7, 1942[5] when the University was evacuated, and originally it was called the Department of land and collective farm law.

This name had existed till March 1989, when it was changed for the Department of Agricultural law and legal protection of environment, and in December 1989 - for the Environmental and Land Law Department (hereinafter referred to as the Department). Heads of the Department [6]

            Over the whole period of the Department history it was headed by well-known law scholars, teachers and law science organizers. They are: A.V. Karass, I.V. Pavlov, N.D. Kazantsev, G.V. Ivanov, V.V. Petrov[7]

 

            Professor Alexander Vassilievitch Karass, Doctor of Law, was the first head of the land and collective farm law Department of the Law Faculty of MSU holding the position within the ten year period from March 15, 1942 till  February 5, 1952. 

            А.V. Karass was born on the 4th of May, 1890. He graduated from the law faculty of the Imperial Moscow University in 1912. Since 1924 he had been teaching at the law division of the Social Studies Faculty (as a supernumerary lecturer), since 1925 - at the soviet law faculty. He defended Candidate’s thesis “The notion of risk in the context of insurance contract” and Doctor’s thesis.  In 1938 he was awarded an academic rank of professor.

            In October 1951, for his long and irreproachable service A.V. Karass was awarded the Lenin Order and earlier – the medal «For the valorous labor during the Great Patriotic War of 1941-1945”. Died on January 25, 1953.

               Professor Ivan Vassilievitch Pavlov, Doctor of Law, took the baton of the Department leadership on February 5, 1952 and had been holding this position till August 26, 1954. Ivan V.Pavlov was born on February 7, 1909 in the town of Buinsk, Tatar Autonomous Soviet Socialist Republic (at present Republic of Tatarstan). He graduated from the Kazan Institute of Soviet system organization and structuring in 1932, and finished the graduate school at the same institute in 1935. In 1939, he defended Candidate’s thesis “The Law of socialist collective farm land tenure” followed by Doctor’s thesis.  In 1951 he was conferred an academic degree of Doctor of Law and an academic rank of professor in 1954.   

                  Professor Ivan V. Pavlov was the author of 112 scientific publications including his co-authorship of pre- and post-war manuals on land law[8]. Ivan V.Pavlov was awarded the medal “For the valorous labour during the Great Patriotic War of 1941-1945”. Died on December 12, 1972. 

 

            Professor Nickolay Dmitrievitch Kazantsev, Doctor of Law, had been the Chairman of the Department from August 28, 1954 till November 12, 1971, i.e. within 17 years. Nickolay D.Kazantsev was born on February 15, 1907 in the village of Obabkovo, Kurgan region (the Urals). He graduated from the law faculty of the First MSU in 1930.   In 1934–1954 he was teaching at the Moscow and Sverdlovsk juridical institutes. He defended Candidate’s thesis in 1938 and Doctor’s  thesis in June  1946.  In 1948 he was awarded an academic rank of professor.  

            Professor Nickolay D. Kazantsev was undoubtedly a son of his epoch. In 1930 he participated in the collectivization campaign, in August-November 1941 he built a defense zone in the avenue of approaches to Moscow, in 1960 he was the secretary of the Communist Party unit at the MSU Law Faculty, combining teaching and research work with the vigorous administration activities.        

In 1946-1948 Nickolay D.Kazantsev was the Deputy Head of the Law Division of the Council for Collective Farms Affairs under the Government of the USSR. Starting from July 1946 he had been a member of the Government Commission for the division of basic principles of landowning in the USSR, starting from 1947 – a member of the Expert Panel on juridical sciences under the Ministry of Higher education of the USSR, and in 1948-1951 he was the Deputy Director of the Institute of Law of the Academy of Sciences of the USSR.   

The major mark was left by him, however, in a different area. Professor Nickolay D.Kazantsev went down into the history of the Department,  the Law Faculty and the Moscow University as a whole – and it won’t be an overestimation to say: in the national history of law teaching – as the founder of the Moscow University’s school of teaching of the legal environmental protection. In 1961 Nickolay D. Kazantsev prepared and published (“for the purpose of discussion”, as the author himself defined) the first article on methodology of teaching of the legal protection of nature. At the same period he also prepared the first academic curriculum for that course. In 1962-1963 first manuals for this course[9] were prepared by him, with his co-authorship or under his guidance.  It was those particular works that initiated teaching this discipline – at those times quite an exotic one – not at the MSU Law Faculty alone, but, further on, at all other higher juridical institutes of the country as well.   

          Nickolay D.Kazantsev was awarded the medal «For the Defense of Moscow» and «For the valorous labor during the Great Patriotic War of 1941-1945».  Died on November 12, 1971.

 

         Professor Georgy Vassilievitch Ivanov was appointed the acting Chairman of the Department on February 10, 1972, and had been heading the Department as Chairman from June 14, 1972 till March 15, 1983. Georgy V.Ivanov was born in Bezhetsk, Kalinin region, in 1920. He graduated from the Moscow Juridical Institute in 1948, defended his Doctor’s thesis in 1952 and was awarded an academic rank of professor in 1968.  

            Georgy V. Ivanov was one of the prominent representatives of the wartime generation: a front-line fighter, a platoon commander, Chevalier of military insignia, a disabled veteran (his arm was amputated as a result of heavy wound), a law school student, the youngest secretary of the Institute’s Communist Party committee (elected as early as being a four year student)… Such  background alone deserves respect and memory. However, in the history of the Department, the  Law Faculty, MSU, as well as in the history of the making and development of the legal  education in the country, Georgy Ivanov will remain, first and foremost, a brilliant organizer of science and teaching.  Suffice it to say that during 17 years running (from February 26, 1965 till March 31, 1982)  he was the Dean of the Law Faculty of MSU. 

            Georgy Ivanov was awarded the II-Degree Order of the Patriotic War, the Sign of Honor Order, and many military and labor medals.  Died on June 22, 1984.

 

            Professor Vladislav Vassilievitch Petrov, Doctor of Law, had been the acting Chairman (since March 15, 1983) and the Chairman of the Department - from 27 December 1983 till January 1, 1995, i.e. within a 12 year period.  

            Vladislav V. Petrov was born in Pavlovsky Posad, Moscow region, on September 2, 1929. He graduated from the Moscow Juridical Institute in 1952 and defended his Candidate’s thesis named “Legal status of collective farm’s indivisible fund” in Moscow in 1962, and his Doctor’s thesis named “A model charter and socialist legitimacy problems in collective farms” in Kazan (at present – the Republic of Tatarstan) in 1971.

            The activities of Vladislav V.Petrov were of multilateral nature: an investigator of a municipal militia department, a journalist, the deputy chief-editor of a regional newspaper, the first secretary of the city young communist league committee, a virgin land pioneer (in 1956 as commander of a special young communist league members’ train he left to develop virgin lands in Kazakhstan for half a year). However, like it was the case with his predecessors, his talent was revealed mostly in the form of a science organizer, tutor and scholar. Vladislav V.Petrov had been the Dean of the Law Faculty of the Kazan State University from 1968 till 1972. Since 1972, after he had moved to Moscow, he had not been only developing the ideas of N.D.Kazantsev, his teacher, but become the founder of a new scientific school, namely he developed a concept of legal mechanism for environment quality control[10].

            He attached a great importance to the educational and methodical support of teaching.  Ten textbooks and manuals on environmental and land law for juridical institutes were prepared and published by him personally or under his editorship.  In many aspects owing to his efforts, the academic course of environmental law elaborated by Vladislav V.Petrov was added to the series of compulsory juridical disciplines being taught in all law schools across the country.  The last work summing up his scientific and training activities was the textbook “Environmental Law of Russia” published in early 1995, with the total print-run exceeding 70,000 copies.     

In 1977 Vladislav V. Petrov won the Lomonosov Prize, in 1989 he was awarded the title of Honored Scientist of the Russian Soviet Federative Socialist Republic. Died on April 18, 1995.

 

Lecturers of the Department

 

            Well-known scholars were teaching at the Department at all times: Professor V.P. Balezin, Doctor of Law;  Professor G.E. Bystrov, Doctor of Law; Professor M.I.Vassilieva, Doctor of Law; Associate Professor A.I. Volkov, Candidate of Law; Associate Professor V.K. Grigoriev, Candidate of Law; Professor E.N. Kolotinskaya, Doctor of Law; Associate Professor O.N. Kouprieva (Sapranova), Candidate of Law; Professor O.I.Krassov, Doctor of Law; A.O. Minyaev, Candidate of Law; Associate Professor G.V. Mironov, Candidate of Law; Professor N.N. Osokin, Candidate of Law, Honored Lawyer of the Russian Federation; Associate Professor M.S. Pashova, Candidate of Law; Associate Professor V.G. Plakhuta, Candidate of Law; Professor A.A. Rouskol, Doctor of Law; Professor A.M. Touroubiner, Doctor of Law, and others. 

The following scholars worked as part-timers in different years: Professor K.A. Bekyashev, Doctor of Law; Professor M.I. Kozyr, Doctor of Law, Academician of the International Informatization Academy, Honored Scientist of the Russian Federation; Professor O.S. Kolbasov, Doctor of Law, Corresponding Member of the Russian Academy of Sciences, Honored Scientist of the Russian Federation; Professor A.S. Timoshenko, Doctor of Law, Professor A.S. Shesteryuk, Doctor of Law and others. A talented lecturer, Associate Professor R.D. Bogolepov, Candidate of Law, Interior Forces Colonel had cooperated with the Department energetically during decades (preparing textbooks and manuals, organization and holding scientific conferences, etc.). 

  

Key scientific and educational-and-methodical works

 

            The above mentioned scientists were the authors of works, which laid the theoretical foundation for environmental law and land law as components of juridical science, formed scientific and educational-and-methodical principles of teaching of the said disciplines and development, on that basis, of environmental and land law as independent branches of law and legislation[11]

            In the field of land law – they are (in chronological order): a textbook «Lecture notes for the course of land and collective farm law» of 1938[12]; textbooks on land law of 1940, 1949, 1958, 1971[13]; a textbook «Land, collective farm law and legal protection of the environment » of 1978[14], «Land Law of Russia» of 1995[15], practical training course «Land Law of Russia» of 1996[16] and others.

            At the same time, it is necessary to mention monographs by A.M. Touroubiner, E.N. Kolotinskaya, V.P. Balezin, A.A. Rouskol[17] and others.

            In the field of legal protection of the environment the following methodical works should be mentioned: the first curriculum for the academic course «Legal protection of nature», the first textbooks and manuals for this discipline[18], textbooks of the period of 1976 – 1995[19].

            A number of monographs on the above mentioned issues were prepared, namely the works by V.V. Petrov, A.K. Golichenkov, I.A. Ignatieva, O.M. Kozyr, O.I. Krassov, T.V. Petrova, M.V. Vassilieva, G.A. Volkov[20].

 

2. The Department today

 

Professors and lecturers

 

At present 15 professors and lecturers are working at the Department, including five professors, Doctors of Law: A.K. Golichenkov (Chairman of Department since 1995), G.A. Volkov, I.A. Ignatieva, E.V. Novikova, O.I. Krassov, T.V. Petrova; nine Associate Professors, Candidates of Law: L.E. Bandorin, A.A. Vorontsova (Tretyakova), E.I. Efimova, N.M. ZaslavskayaO.M. Kozyr, A.L. Korneev, N.G. Narysheva, S.N. Rusin, D.V. Haustov; one assistant, Candidate of Law: S.R. Bagautdinova. There are 5 graduate students and 2 aspirants at the Department. Organization and support of the Department activities are provided by laboratory assistant G.V. Demchenko.

So, 14 out of the 15 professors and lecturers are graduates from the Law Faculty of MSU, 12 out of the 15 finished the Graduate School of the Law Faculty at this Department; 5 out of the 15 were trained and/or educated abroad. Thus, G.A. Volkov was trained at the Law Faculty of Budapest University, also known as University named after Lorand Etvesh (Eötvös Loránd Tudományegyetem, Budapest, Hungary www.elte.hu); A.K. Golichenkov – at the Environmental Law Institute (Washington, DC,  USA, www.eli.org) and at the Law Faculty of the Catholic University of Löven, Belgium (Katholieke Universiteit Leuven, www.kuleuven.be/kuleuven/); I.A. Ignatieva – in the Pacific Center for Environment and Natural Resources Protection (San-Francisco, California, USA, www.pacificenvironment.org) and at the Law Faculty of Kiev National University named after T.G. Educational work of the Department

 

The main line of the Department activities is teaching, namely a skilled organization of teaching process on the basis of approved national standards, the Law Faculty academic plan and the Department curricula.  At present two general law disciplines of federal component (level) are being taught, namely Environmental Law and Land Law.      

The Environmental Law course provides for a general set of lectures for full-time students (the lecturers are Professor A.K. Golichenkov, Professor I.A. Ignatieva, and Associate Professor S.N. Rusin) and for special division students (Associate Professor N.G. Narysheva), 36 hours each; practical training workshops (36 hours) and weekly consultations (36 hours) are organized; guidance for term papers and graduation thesis writing is ensured. Professors of the Department (A.K. Golichenkov, T.V. Petrova) deliver lectures on the Environmental Law (36 hours) in the framework of the international law course in Geneva, Switzerland.

The Land Law course provides a general series of lectures for full-time students and for the special division respectively (the lecturers are ProfessorG.A. Volkov, Professor I.A. Ignatieva and Associate Professor N.G. Narysheva). Professor G.A. Volkov teaches this course at the international law division in Geneva.  

Besides, the Department teaches special disciplines at students’ choice within their specialization profiles. At present those are the following 10 disciplines in the framework of the Bachelor Curriculum: Environmental law researches in the making and development (Associate Professor E.I. Efimova), Protection of the rights of nature users in the implementation of environmental supervision and control (Associate Professor N.M. Zaslavskaya), Legal mechanism of environmental protection and nature management (Professor T.V. Petrova), Protection of rights to land plots (Professor G.A. Volkov), Features of registration of rights to land plots by ‘country amnesty’ (Associate Professor E.I. Efimova), Legal regulation of land plots under electric power facilities (Professor I.A. Ignatieva), Legal regulation of the use of lands of settlements (Associate Professor O.M. Kozyr), Land plot as the object of land relations (Associate Professor N.G. Narysheva), Subsoil management in the Russian Federation: legal basis (Associate Professor A.A. Vorontsova, Associate Professor N.M. Zaslavskaya Legal regulation of town-planning activities (Assistant L.E. Bandorin).

Also, the Department offers four inter-faculty courses: “Global environmental problems and law” (Professor T.V. Petrova, Associate Professor S.N. Rusin), Land, Law, Business (Associate Professor A.A. Vorontsova, Associate Professor N.M. Zaslavskaya, Associate Professor S.N. Rusin), Legal Regulation of the Management of Natural Resources (Associate Professor A.A. Vorontsova, Associate Professor N.M. Zaslavskaya, Associate Professor S.N. Rusin) and ‘Green Economy’: environmental, legal and economic fundamentals (Professor I.A. Ignatieva and Professor S.N.Bobylev).  The latest of the mentioned courses is taught in conjunction with Professor S.N.Bobylev, a Professor of the Faculty of Economics of Moscow State University named after M.V. Lomonosov. 

 

Together with the Entrepreneurial Law Department of the Law Faculty the teaching of one inter-departmental course “Energy Law and Environmental Protectionn” (Professor G.A. Volkov, Associate Professor N.M. Zaslavskaya, Professor I.A. Ignatieva, Associate Professor O.M. Kozyr, Professor T.V. Petrova, Associate Professor D.V. Haustov, Associate Professor P.G.Lakhno[21]) is offered.

Apart from the mentioned above, the following eleven special courses have been prepared and offered for study: Methodological problems of the environmental law (Professor A.K. Golichenkov), Actual problems of the natural resources law (Professor A.K. Golichenkov, Professor G.A. Volkov), Legal problems associated with the economic mechanism for environmental protection (Professor T.V. Petrova), Legal regulation of use and protection of resources of the territorial sea, continental shelf and exclusive economic zone of the Russian Federation (Associate Professor S.N. Rusin). Specifics of the registration of rights in land (Associate Professor E.I. Yefimova), Legal regulation of the use of lands of settlements: land and town-planning laws (Associate Professor O.M. Kozyr), Legal regulation of land use for the development of settlements (Associate Professor O.M. Kozyr),  Legal regulation of using land for housing development human settlements (Associate Professor O.M. Kozyr), Legal regulation of land transactions (Associate Professor A.L. Korneev), Compensation for damage caused by environmental offenses (Associate Professor N.G. Narysheva), Environmental and Legal Aspects of the Activities of a Corporate Lawyer (Associate Professor N.M. Zaslavskaya), Environmental rights of citizens under the law of the European Union member states (A.A. Vorontsova).

In academic year 2015/2016, for the first time at the Faculty of Law, the teaching of the master’s program Legal Regulation of Land Use and Real Estate Establishment prepared by the Department began. The developer and leader of the master's program is Professor G.A. Volkov. The program enrolled of 17 people in academic year 2015/2016, 15 people in 2016/2017, 19 people in 2017/2018, 18 people in 2018/2019.

As part of the master's program, the following required courses and special courses (optional disciplines) are offered for study. Currently, these are eleven required disciplines, seven in the first year: Provision of land plots for construction. Withdrawal of land plots for state or municipal needs (Associate Professor L.E. Bandorin, Associate Professor A.A. Vorontsova), System of land rights (Professor G.A. Volkov, Professor E.V. Novikova), Legal problems of the economic mechanism for the use of lands and other natural resources" (Professor T.V. Petrova), Legal responsibility for violations in the field of environmental protection and nature management (Associate Professor D.V. Haustov), ​Town-planning law (Associate Professor L.E. Bandorin), Legal regulation of development on land of different categories (Associate Professor O.M. Kozyr), Management in the field of use and protection of lands and other natural resources (Associate Professor N.M. Zaslavskaya) and four required disciplines in the second year: Environmental requirements for the placement, design, construction, reconstruction, commissioning, operation, conservation and liquidation of real estate (Associate Professor O.M. Kozyr), Verification of rights to land plots in the implementation of investment projects (Associate Professor O.M. Kozyr), Formation of land plots. State cadastral registration of land plots and capital construction projects (Associate Professor N.G. Narysheva), Environmental Law of the European Union" (Professor E.V.Novikova, Professor G.Winter (Germany)), as well as twelve elective disciplines, six of them are offered for study in the first year: Registration of rights to land plots and real estate located on them (Associate Professor E.I.Yefimova), Features of transactions with land plots (Associate Professor A.L.Korneev), Legal regulation of underground structures unrelated to mining (Proftssor E.V.Novikova), International legal regulation of environmental protection (Professor E.V.Novikova), Formation and development of environmental and legal research (Associate Professor E.I.Yefimova), Legal regulation of the territories with special conditions of development (Associate Professor S.R.Bagautdinova); six disciplines are offered in the second year: Protection of rights to land plots (Professor G.A. Volkov), Land supervision and control (Associate Professor N.M. Zaslavskaya), Restrictions on land rights (Associate Professor A.A. Vorontsova), Legal instruments for the development of built-up territories and integrated development of territories (Associate professor L.E. Bandorin), Environmental risks. Legal support of environmental safety of potentially environmentally hazardous facilities (Associate Professor S.N. Rusin), inter-departmental special course Environmental and land relations in entrepreneurial activities (prof.T.V.Petrova).

The majoring students as well we the students preparing their term papers and graduation theses are invited to attend the annual sessions of All-Russia School of Young Ecology Scholars (for more details see the chapter “Sofrinskiye” Conferences and Schools of Young Law Scientists). Starting from 1995, 470*** term and 379 graduation papers have been prepared at the Department. Starting from 2017 (from the first graduation of the Master’s Program), 52 graduate qualification master's theses (master's theses) have been defended at the Department. The Society of Environmental and Land Law Experts (abbreviated as EZOP in Russian), a students’ scientific club, works at the Department (headed by Associate Professor O.M. Kozyr). Section of environmental and land law works within the framework of the annual students’ scientific conferences.

    

Educational and methodical work of the Department

 

            At present the Department is fully supplied with new curricula for all general and special disciplines. In 1999 the academic curriculum “Land Law in Russia”[22] was prepared, approved by the Departmental meeting, endorsed by the Law Faculty Council and recommended by the Council on Jurisprudence of Educational and Methodical Association of the Universities of the Russian Federation. In 2000 the academic curriculum “Environmental Law of Russia”[23] was prepared. They are updated annually. The curricula with the latest amendments were published in 2009[24]. In 2015, the first Master’s curriculum of the Department was prepared and approved – Legal Regulation of Land Use and Real Estate Establishment (published in 2016[25]), it was re-approved in 2019. Besides, the curricula for special disciplines[26] The curricula for the required disciplines are being prepared for reedition in 2019. It is planned to publish the curricula of special courses prepared by the professors and lecturers of the Department for teaching in the framework of the Bachelor and Master profiles in the same volume.

During the last 24 years 19 textbooks, 58 manuals, 38 scientific and practical commentaries have been prepared and published by the Department (or with the participation of its professors and lecturers). The Department contributed a lot to the development of the fundamentally new Subject Classifier of Legal Acts[27]. Subsequently its concept laid the foundation for the Legal Acts Classifier that was approved by the Decree of the President of the Russian Federation[28]. In December 2000 the collection of scientific articles by the Department lecturers and graduate students was issued with the dedication to the memory of Professor V.V. Petrov, formerly Chairman of the Department[29]. During the 24 year period 6 issues[30] of the materials of “Sofrinskiye” scientific and practical conferences were prepared: in 1999, 2001, 2002, 2003 and two of them – in 2009 (in 2019-2020, the seventh edition of the materials of scientific and practical conferences is being prepared for publication). The sixth collection of materials was specially prepared to the 80th anniversary of his birth. In 2014, the selected works by V.V. Petrov were re-issued[31]. During the 24 years the environmental law practical course was re-issued 5 times: in 1996, 2001, 2004, 2011, 2016[32], the land law practical course was re-issued 5 times: in 1996, 2001, 2005, 2007[33]. The dictionary of juridical terminology of the environmental law[34] and the bibliography of scientific papers on the environmental law[35] issued in 2008, 2012 and 2016 are important elements of the educational and methodological complex on environmental law along with other publications. The bibliography was first issued in 2007, the second edition, supplemented and revised, was issued in 2017[36] and others.

In 2014 Studies[37] of the Law Faculty of MSU named after Lomonosov (Volume 14)[38], a collection of the latest research papers on environmental law issues prepared by the Department members, was published. The publication includes “Legal regulation of environmental supervision in the Russian Federation”, a monograph by N.M. Zaslavskaya, Department Associate Professor.

The Department staff is preparing a textbook on environmental law and another one on environmental law for publication in 2019.   

     

Scientific Work at the Department

 

Scientific research at the Department is traditionally carried out in two main areas: legal protection of the environment, legal regulation of the use and protection of land and other natural resources.   

            Within the above mentioned areas the following issues are of priority: notion, subject and system of the environmental law, problems of the environmental laws enforcement, problems of formation of new environmental legislation, the theory and juridical techniques of law making activities, problems of the environmental law teaching (in a broad sense) and organization of the environmental law research, the theory of environmental law (particularly, the environmental law  terminology, the methodology of the environmental law), problems of the juridical education development in Russia, mediation and law (A.K. Golichenkov), legal problems of the environmental regulation, legal problems of economic encouragement and financing of the environmental protection activities, problems of improvement of the mechanism of payments for the use of nature, legal problems of efficiency of the environmental protection economic mechanism (T.V. Efimova); environmental rights, environmental law, reservation of land, international environmental law, environmental law of the European Union member states (A.A. Vorontsova); fundamentals of the methodology of environmental law; legal basis of the participation of the state in environmental relations; the theory of environmental law means; instruments of environmental law influence: the theory and relationship with the instruments of other branches; public law instruments as a means of implementation of the role of state in the environmental law; a proportion of basics of public law and private law in the environmental law; the legal basis of treaty regime of the use of natural resources; relationship of the civil and environmental law, public agreements as an instrument of the state regulation (by example of the natural resources management), legal nature of the rights to natural resources, grounds for the emergence and termination of rights to land and other natural resources, legal basis for participation of the state in environmental relationship, instruments of environmental law influence (D.V. Haustov); development of the town planning legislation, development of the environmental law of the city of Moscow, harmonization of the land law and on urban planning law (L.E. Bandorin); legal regulation of the state environmental control in the Russian Federation (N.M. Zaslavskaya); legal regime of lands, legal regulation of the protection and use of natural resources, the legal regime of specially protected territories and objects (S.R. Bagautdinova); environmental functions of the state, state environmental policy, organization of public administration in the field of environmental protection, the relationship between environmental protection and environmental safety, the use and protection of living and mineral resources of marine spaces, the organization of environmental protection in federal executive bodies, in which federal laws military service is provided (S.N. Rusin); state participation in environmental and legal relations, consideration of disputes in the field of subsoil use by arbitration courts, the mechanism of environmental protection in an international body of water during oil operations, the reform of the Russian legislation on mineral resources, the responsibility of the nature user for environmental damage caused by previous economic activities, accumulated environmental damage, environmental safety, environmental insurance, mediation in the oil and gas sector of Russia and the Republic of Kazakhstan (E.V. Novikova).

The Department staff members carry out fruitful scientific research. Thus, within 1995-2019 over 947 publications were prepared at the Department, with more than 83 of them prepared by the graduate students and students.

            The Department staff members draw much attention to preparing works of scientific and, at the same time, practical nature, namely commentaries on laws and collections of normative legal acts.             Training of post-graduate students, graduate students and aspirants forms an important component of the scientific work of the Department. Within the recent 20 years 5 persons have finished the post graduate course at the Department (M.I. Vassilieva, G.A. Volkov, I.A. Ignatieva, О.М. Коzyr, T.V. Petrova). Four of them defended their Doctor’s thesis. T.V. Petrova defended her Doctor’s thesis named “Problems of legal support of the economic mechanism of environmental protection” on the 13th of October 2000. The Doctor’s thesis of M.I. Vassilieva “Public interests in the environmental law: theory and practice of legal regulation” was defended on June 16, 2003.  On the 8th of June 2005 G.A. Volkov defended his thesis “Principles of land law”. On the 10th of October 2007 I.A. Ignatieva defended her thesis “Environmental legislation of Russia: the theory and practice of systematization”.

            Participation in scientific forums is a priority of the Department activities. «Sofrinskiye» conferences and Young Law Scientists Schools

            The Department is apparently the only structural division of a juridical higher educational institution in Russia, which, starting from March, 1995 has organized and held two scientific forums of all-Russia level annually: in spring, those are scientific and practical conferences which were called “Sofrinskiye” because the first event took place in Sofrino, a village in the Moscow region; and in the autumn-winter season - the Schools for Young Law Scientists majoring in the environmental and land law legal problems. Both the conferences and schools are held under the auspices of the Law Faculty of MSU. 24 conferences[57] and 22 school sessions took place all in all.    

            Traditionally, leading scientists and practicing lawyers (about 100 persons) working in the field of land, forest, water, mining, environmental law and legislation participate in the conferences, where reports are delivered, scientific discussions are held on the most burning environmental and legal problems. As a rule, all the major scientific and educational centers of environmental law are represented at the conferences: the Law Faculty of MSU, the Institute of State and Law of the Russian Academy of Sciences, the Institute of Legislation and Comparative Law under the Government of the Russian Federation, the Moscow State Juridical Academy, Private Law Research Center under the President of the Russian Federation, the Law Faculty of the St. Petersburg State University, Ural State Juridical Academy and others.    

            Starting from 1996, the Department has annually held sessions of the Young Law Scientists School (hereinafter referred to as the School). The conference venues are chosen among places of unique natural identity, as well as of rich historical background and cultural traditions. Thus, the Schools were held in Suzdal (22-25 April, 1996), St. Petersburg (27-29 November, 1997), Tver (22-24 September, 1998), Tula (13-15 December, 1999), Petrodvorets (9-12 September, 2000), Sochi (3-5 September, 2001), Veliky Novgorod (25-27 November, 2002), Yaroslavl (1-3 December, 2003), Kremenki, Kaluga region (29 November - 1 December, 2004), Kemer, Turkey (18-25 October, 2005), Solovetsky Islands (13-15 September, 2006), Anapa (8-10 October, 2007), Saransk (15-17 September 2008), Svetlogorsk, Kaliningrad region (7-9 September, 2009), Vyborg (6-9 September, 2010), Yekaterinburg (12-14 September, 2011), Geneva, Switzerland (9-12 September, 2012), Kamenyuki, Kamenetsky District, Brest Region (Republic of Belarus) October 13–15, 2014), Kazan (May 11–13, 2015), Suzdal (October 12–13, 2015, the 20th Anniversary School was held at the venue of the first School), village of Artybash of the Altai Republic (September 6-8, 2016), Saratov (October 2-4, 2017).         

            The key tasks of the School are to identify the above mentioned specialists and include them into the data base, to teach them under the School’s program, to enhance the level of their legal and general culture; to ensure their subsequent informational support; to facilitate establishing and maintaining professional contacts between them. In the framework of the School sessions a broad cultural program is offered to the participants.  

The students of the School are young scientists (teachers and researchers, graduate students, senior students of all leading juridical institutes and scientific entities of Russia) of the age below 35, majoring in problems of legal regulation of relations in the sphere of environmental protection, sustainable use of land and other natural resources, ensuring ecological safety for human beings, and other objects, and working under Specialization Code No. 12.00.06.   

             

Participation of the Department staff members in the law drafting work

             Since 1995, professors and lecturers of the Department have contributed to the elaboration of over 128 draft laws, prepared legal opinions on more than 92 draft laws, as well as on draft resolutions of the Plenary Meetings of the Supreme Court and the Higher Arbitration Tribunal of the Russian Federation.   

            Of special note is the scientific support of law drafting provided by the Department. First of all, it goes about elaboration of a development concept for the branches of law comprising the so-called ecology block[58]. It is the Department staff that was the first to identify and carry out a research study of the problems associated with the elaboration of such concepts[59]

                  It’s significant that the official recognition of the necessity of such concept development only came a few years later. It was not until 1994, that a conclusion was made in the National Report on the State of the Environment in the Russian Federation saying that: “It is necessary to incorporate the law drafting activities into a uniform system of legal acts, to develop a concept of legal regulation of the environmental protection and natural resources utilization”[60]. In the similar report for 1995 the development of this concept was already defined as primary task[61]. In 1997 the necessity of conceptual justification of the land law development was identified in the Draft Concept of Land Reform Development in the Russian Federation (1997-2002) prepared by Goskomzem (the State Committee on Land) of Russia. The Draft Law envisaged that “the main lines of development of the normative legal base for the real estate market (as regards the legal fundamentals of the land market development and operation) provide for separation of the conceptual development of general and specific nature (of the land market) and that of the development of a set of legislative and other normative legal acts”[62].

                  The Department staff members have elaborated or contributed heavily to the elaboration of scientific concepts of sanitary (A.K. Golichenkov, 1989-1990), land (G.A. Volkov, A.K. Golichenkov, O.M. Kozyr, 1995-1997), environmental (A.K. Golichenkov, 1995-1996) branches of legislation[63]. The Department staff members took part in the development of the Concept of formation of new environmental legislation of the Republic of Kazakhstan (A.K. Golichenkov, I.A. Ignatieva, 1994) [64].

            Among the draft laws developed with the participation of the Department staff members the following should be noted first of all:  author’s draft of the Federal Law on Land (A.K. Golichenkov, O.M. Kozyr).[65] In June 1994 г. it was introduced to the State Duma (hereinafter – the State Duma) as an alternative to the Government’s draft of the Land Code of the Russian Federation (hereinafter Land Code of the Russian Federation). It was this particular draft that was taken by the State Duma working team as a basis, finalized and agreed upon by November 1994 with specialists of all the state bodies concerned: the Administration of the President, Agrarian Committee of the State Duma, the Government, the Land Committee of the Russian Federation, Ministry of Agriculture and others (the so-called “agreed version” of the Land Code of the Russian Federation).

            Of special note is the fact that the Department staff members (G.A. Volkovv, A.K. Golichenkov, O.M. Kozyr) are the authors of the basic draft of the Land Code of the Russian Federation adopted on the 25th of October 2001[66]. The working team responsible for preparing the draft federal law was headed by Professor A.K. Golichenkov, the Chairman of the Environmental and Land Law Department.

            The Department staff members (M.I .Vassilieva, G.A. Volkov, A.K. Golichenkov, N.M. Zaslavskaya, T.V. Petrova, D.V. Haustov) have elaborated the General and Special Parts of the Environmental Code of the Russian Federation (2007-2008 гг.). The research work was carried out under the guidance of  A.K. Golichenkov.

            While drafting the Special Part of the Environmental Code, the Department organized and held scientific debate “Theoretical problems of preparation of the Russian Federation Environmental Code” (22 November 2007), Faculty of Law of MSU named after M.V. Lomonosov).       

            Apart from that the Department staff members were deeply involved into preparing the following drafts: land law code (N.N. Osokin – versions of 1994-1998), previously  effective water (G.A. Volkov, N.N. Osokin) and forest (N.N. Osokin) codes, as well as currently effective water (G.A. Volkov) and forest (O.I. Krassov, T.V.                   Among the draft laws of the subjects of the Russian Federation prepared in collaboration with  the Department staff members the following should be mentioned: drafts laws of the city of Moscow “On charges imposed on moving objects’ pollutant emissions on the territory of Moscow”, “On the application of waste gas neutralizers of the used up and other technical devices of motor vehicles” and  «On the responsibility for selling motor fuel  non-compliant with the ecological safety requirements” (G.A. Volkov, A.K. Golichenkov, T.V. Petrova); draft laws of the city of St. Petersburg “On participation of the population of the city of St. Petersburg in discussions and making decisions related to the city territory development  planning and territory zoning plan” and “On zoning the territory of the city of St. Petersburg” (G.A. Volkov, A.K. Golichenkov, O.M. Kozyr), the law of Moscow “On industrial wastes and consumption residues” (A.S. Shesteryuk), the law of Moscow “On the integrated environmental management" (A.S. Shesteryuk), etc.

The Department was also represented in the working groups preparing the draft laws of the Republic of Kazakhstan “On environmental protection” and “On environmental impact assessment” (A.K. Golichenkov), and the draft of the City Planning Code of the Republic of Tatarstan (L.E. Bandorin) and others.

In 2012 a group of scientists of the Department was preparing proposals to improve legislation in the field of environmental protection insofar it concerns the effectiveness of state environmental supervision (A.K. Golichenkov, M.I. Vassilieva, G.A. Volkov, N.M. Zaslavskaya, N.G. Narysheva, T.V. Petrova). In 2013, the staff members of the Department were actively involved in the development of proposals for the improvement of legal regulation in the sphere of water relations of the Russian Federation (A.K. Golichenkov, M.I. Vassilieva, G.A. Volkov, N.M. Zaslavskaya, O.I. Krassov, N.G. Narysheva, T.V. Petrova).

 

Cooperation of the Department staff with the state bodies
